On 16 March 2021, the Prime Minister issued Decision No.10/2021/QĐ-TTg guiding criteria for enterprises to be classified as “high tech”, which will be effective from 30 April 2021 and replace Decision No.19/2015/QĐ-TTg dated 15 June 2015. This Decision applies to enterprises manufacturing hi-tech products and providing hi-tech services in Vietnam. In which,

A hi-tech enterprise must satisfy all the following conditions:

1. The criteria are unchanged from the previous regulation (*):

  • It manufactures hi-tech products on the list of those encouraged for development;
  • Applying eco-friendly, energy-saving solutions to manufacturing and quality control in accordance with Vietnam’s technical regulations and standards (or international standards if no Vietnam’s technical regulations and standards are available).

2. New criteria are introduced:

  • Revenues generated from hi-tech products must account for at least 70% of total annual net revenue;

Transition clauses: Enterprises that have submitting application for issuance of hi-tech enterprise certificates before the effective date hereof and have not received the certificates shall conform to this Decision.
