The new Section 17A of the Malaysian Anti-Corruption Commission (MACC) Act 2018 has imposed a burdensome corporate liability on Malaysian businesses for the first time. Under this provision, directors and senior management are liable for the actions of the company if it is involved in bribery unless it can prove that it has successfully implemented adequate procedures to prevent bribery from happening.
