Noel Kersh is a principal in the advisory group at Crowe and is the leader of the firm's digital forensics team. He has extensive experience in conducting digital forensics acquisitions and analysis on a variety of cases involving business and employment disputes, compliance with discovery requests, family law, harassment, in-house investigations for large corporations, copyright infringement, and criminal cases.  

Prior to joining Crowe, Noel spent over 12 years leading Pathway Forensics, where he oversaw every aspect of the company, established the digital forensic lab operational policies and procedures, and provided leadership and mentoring for Pathway Forensics staff.  Prior to joining Pathway, Noel helped lead two initiatives to receive a distinguished laboratory accreditation given by the American Society of Crime Laboratory Directors/Laboratory Accreditation Board (ASCLD/LAB). This accreditation demonstrates that a computer forensics laboratory’s operating standards meet quality standards set by ASCLD/LAB. Accreditation criteria include personnel, technical procedures, equipment, and physical facilities.  

Noel has extensive expert witness testimony experience in matters involving digital forensics, including trials, hearings, depositions, affidavits, and declarations in matters before family courts, arbitration, state courts, and federal courts. Noel is an EnCase Certified Examiner (EnCE) in computer forensics.

Experience

Digital forensics
  • Conducted analysis on an intellectual property matter involving over 150 pieces of digital evidence to trace the transfer of client data to a competitor
  • Served as court-appointed independent forensic examiner to investigate over 40 pieces of evidence and report findings
  • Conducted a highly sensitive examination of over 50 pieces of evidence in a condensed timeline to meet a court-ordered deadline
  • Assisted client with a large-scale remediation effort that spanned five states and over 50 pieces of evidence
Investigations
  • Found proof of evidence spoliation which resulted in jail time for the offender
  • Extracted and examined DLP logs to conduct an investigation into former employee activities when company laptop was returned wiped
  • Uncovered coordinated data wiping activity which resulted in severe sanctions, including an adverse inference instruction at trial
